Thursday was a wildly busy day in the courts:
Federal Judge Orders USDA to Fully Fund SNAP Program
MORNING MUSING
They say you may’t get blood for a turnip, but Rhode Island District Court Judge John McConnell Jr. is doing his damnedest. As we reported yesterday, McConnell issued another order in the case concerning SNAP advantages, this time, insisting that the Trump administration fund the SNAP program — in full — by today.

Never thoughts that this would entail forcing the USDA to pull money from other packages. Never thoughts that the SNAP program itself arguably ceased to exist as of September 30. Never thoughts that, even if it had been legal and acceptable to mix the contingency fund with funds from WIC (Special Supplemental Nutrition Program for Women, Infants and Children), that would deplete those packages/funds and do nothing to deal with following months. Never thoughts that the only real cause this system’s funds usually are not out there is that Senate Democrats will not vote to reopen the federal government.
No. Forget all of that. Judge McConnell has decreed that the USDA must cobble together funds — legal and sensible impediments be damned — and do it now.
The administration has — rightly, in my view — appealed McConnell’s orders to the first Circuit Court of Appeals, and we will count on, at minimal, a ruling someday today on an administrative keep. (The appellate court ought to issue one, but this is a court that hasn’t been ruling in favorable fashion to the administration, so I’m not holding my breath on that.)
And it is not that I’m heartless or need people to go hungry. It’s that I would like our Constitution and our legal guidelines to be adopted. I would like Congress to do its job. And I would like the judiciary to do its job. Because if they continue on this path, they are going to drive the administration to call their bluff. And when/if that occurs, it is not going to be fairly. The system works (considerably) when the branches keep in their lanes and use their lawful powers to verify one another. But of the three branches, it is the judicial department that, fact be told, has no tooth. And McConnell and his indignant cohorts are about to expose that for all the world to see.
