Judge Issues Scathing Ruling on Emergency Motion | Political News

Judge David Carter of the Central District of California ruled against the Department of Justice’s emergency movement to require California and Los Angeles County election officers to sequester ballots returned by those on a checklist of 20,000 people the federal authorities had decided to be “likely noncitizens.”

In a scathing 26-page order, Carter likened the federal authorities’s effort to forestall unlawful aliens from voting to efforts to keep black Americans or girls from voting, and to Jim Crow-era legal guidelines like “poll taxes, literary tests, and other obstacles to prevent people from casting their vote.”

In the introduction, he wrote:

Never before in American historical past has the federal authorities, on the eve of an election, sought to coerce a state and local authorities to abandon their own Constitutional elections procedures and bend to the need of the Executive Branch. In bringing this lawsuit, the Executive would have this Court consider that it reigns as a sole sovereign. But California and its people are sovereign, too.

Every technology in our historical past has witnessed repeated clashes between those who search to restrict access to the poll and those who combat to guarantee it. In this case, the federal authorities seeks to segregate and exclude over 20,000 ballots. This request violates longstanding constitutional rules mandating that states have control over their elections. If Plaintiff’s last-minute request for reduction had been granted, either get together may create chaos for their own political functions to disrupt the election course of. Over 20,000 registered Californians would probably lose the correct that generations of Americans have fought to protect.

Except that every county in the state already segregates ballots that have been challenged for a number of causes, including citizenship. It appears that Judge Carter needs people to problem each of the people on that checklist individually.

The ruling shall be appealed to the ninth Circuit Court of Appeals, and could be read below in its entirety.
