After the Virginia redistricting energy grab election on Tuesday was gained by the Democrats, RedState reported that the battle was far from over. Now the battle strikes into the court system, and that will resolve the ultimate destiny of the constitutionality of this referendum.

It did not take long. On Wednesday afternoon, Tazewell Circuit Court Judge Jack Hurley Jr. ruled that Tuesday’s referendum is unconstitutional and issued an injunction stopping the certification of the election maps. Judge Hurley has also denied any movement to keep his ruling pending appeal.

Tuesday’s referendum might not be the ultimate phrase. The state Supreme Court is contemplating whether or not the redistricting plan is against the law in a case that may make the referendum outcomes meaningless.
