The Senate, on Monday, voted to invoke cloture on the nomination of Eric Chunyee Tung to the ninth Circuit Court of Appeals, transferring him one step nearer to affirmation. Late Tuesday morning, they will vote — again — on the clean persevering with decision (CR) (H.R.5371), and then, in the afternoon, on the affirmation of Joshua D. Dunlap for the first Circuit Court of Appeals.

There are two conferences/hearings set for Tuesday, as effectively:

The Supreme Court will hear oral argument in two more instances on Tuesday:





  1. Coney Island Auto Parts v. Burton — Whether Federal Rule of Civil Procedure 60(c)(1) imposes any time restrict to set apart a void default judgment for lack of personal jurisdiction.
  2. Hain Celestial Group v. Palmquist — 
    1. Whether a district court’s remaining judgment as to utterly numerous events must be vacated when an appellate court later determines that it erred by dismissing a
      non-diverse celebration at the time of removing.
    2. Whether a plaintiff could defeat variety jurisdiction after removing by amending the criticism to add factual allegations that state a colorable declare against a nondiverse celebration when the criticism at the time of removing didn’t state such a declare

Today, of course, is Election Day in a number of jurisdictions, and we’ll be watching the outcomes intently — significantly in California (Prop. 50), New Jersey, New York City, and Virginia — and reporting on them right here later this night.

As famous above, it is Election Day. These are off-year elections, and not every state or municipality is holding them today. (Here in the St. Louis space, there are only elections in choose municipalities — not mine — largely for some type of tax increase. One would hope those do not go, but their being held when such low turnout is anticipated would not weigh in favor of that.)

I do know most of our readers aren’t in California, New Jersey, New York, or Virginia, but many are — and your vote counts, even if you are not overly optimistic of your candidate or place rising victorious. 

Think of it this manner: In 2020, Joe Biden (allegedly) obtained 81 million votes to Donald Trump’s 74 million, so Biden bought the “win.” But setting apart the mountain of questions and doubts surrounding that election, one factor no one may deny was that 74 million Americans (at least) most popular the other man and held a different imaginative and prescient. Your vote — even when it would not back the profitable candidate or place — wants to be registered. 





Frequently, I see or hear people expressing doubt, characterizing a explicit vote/election as a misplaced trigger. I perceive the frustration. It might be straightforward to grow to be discouraged — but do not. If there’s an election in your space today, go vote (if you have not already). Do it.
