The Walt Disney Company agreed to pay a $10 million civil penalty to settle a kids’s privateness case.
A federal court announced Tuesday that the DOJ “entered a stipulated order resolving” the case against Disney — including Disney Worldwide Services and Disney Entertainment Operations — over alleged violations of the Children’s Online Privacy Protection Act (COPPA) via YouTube, which prohibits “operators from knowingly collecting, using, or disclosing personal information from children under the age of 13 unless they provide notice to and obtain consent from those children’s parents,” according to the Federal Trade Commission.
A lawsuit was filed in U.S. District Court for the Central District of California by the federal authorities alleging that the leisure company failed to correctly label its YouTube video content for kids, which is watched by billions in the U.S. alone, the DOJ said in a press release Tuesday. The case was filed by the DOJ at the advice of the FTC.
It alleges that Disney and its companions used focused promoting to unlawfully acquire kids’s data without their dad and mom’ consent, which is a direct violation of COPPA.
“The Justice Department is firmly devoted to ensuring parents have a say in how their children’s information is collected and used,” said Assistant Attorney General Brett A. Shumate of the Justice Department’s Civil Division. “The Department will take swift action to root out any unlawful infringement on parents’ rights to protect their children’s privacy.”
Disney will also be compelled to institute a program that ensures that its YouTube content complies with COPPA on YouTube, the DOJ said, in addition to the civil penalty.
All content will need to be labelled “Made for Kids” when acceptable transferring ahead to stop potential COPPA violations.
It will also require Disney to inform dad and mom of kids under 13 about the data it’s amassing.
Lawmakers have labored relentlessly in latest years to add additional protections to COPPA as kids more and more use the web without parental supervision at an exponential charge.
